Nairobi Senator Mike Sonko was on Thursday given three days to file a substantive application to quash the decision by the Nairobi County Government to re-configure three roundabouts.
Justice Weldon Korir directed Sonko to serve the application on the Nairobi County Government, Transport Ministry and the National Transport and Safety Authority.
The respondents were also asked to reply to the application within seven days before the case is heard on May 6.
The county however opposed the case explaining that it had been overtaken by events.
Governor Evans Kidero argued that the re-configuration was one of the plans undertaken in efforts to decongest the city.
His office further said it was its mandate to exploit measures including re-configuration of roundabouts to improve flow of traffic in the city.
In his view, the court should not issue an injunction to prohibiting it from implementing what has been agreed.
He also explained that two roundabouts had already been opened up at the time the case was filed.
Sonko moved to court on Tuesday to compel the country government to open closed portions of three roundabouts in Nairobi.
Kidero however on the same day ordered for the temporary re-opening of the Bunyala and Lusaka roundabouts which connect Uhuru Highway, Mombasa and Langata Roads.
He said they will however be closed again on Friday when the Eastern by pass will be ready for use.
